RE: Amended Solid Waste Local Law

Increasing the surcharge fines from a maximum of $500 to $2,000 per violation for those in violation of Madison County’s revised Solid Waste Local Law is but one of the major changes approved by the Madison County Board of Supervisors on October 12. The Board determined that Local Law No. 3 of 2004 would enhance the effectiveness of the County Solid Waste Management Program and ensure the safe and proper disposal of the solid waste and recyclables generated by the residents, businesses and institutions in Madison County. James A. Zecca said, “The increased surcharge and criminal penalty allows for quicker enforcement action (fewer citations), while still providing an incentive to comply. A new billing system that went into effect in September allows haulers to choose to pay at the time they deliver waste to the landfill, or to be billed monthly. The revised Local Law adds a provision for failure to pay tipping fees, explained Zecca. However, in all cases, interest will be imposed on late fees and will be applied to all past due accounts. The interest rate imposed has been determined by a Board of Supervisor’s resolution and has been set at 1.5 percent per month. Another revision in the Solid Waste’s Local Law requires an increase in the amount of insurance carried by commercial haulers.
