Restitution

Judges in criminal and family courts in New York State are empowered to order restitution to the victim(s) of criminal or delinquent acts. The defendant/respondent can be ordered to pay reimbursement to the victim(s) for damages and expenses incurred as the result of criminal or delinquent activities. New York State Criminal Procedure Law specifies that the Court will establish the amount owed and the terms of repayment while the Probation Department will collect funds from the defendant/respondent and disburse those payments to victims. The Probation Department is additionally responsible for notifying the court of the offender's compliance with the order. A New York State DPCA press release in July 2009 states that nearly $18 million is collected annually in victim restitution funds.

In Madison County, offenders may make restitution payments at the Madison County Probation Department during normal business hours or by mailing them to the department at P. O. Box 23, Wampsville, New York 13163. Certified checks, bank checks, or money orders are preferred. Cash and Personal checks may also be accepted. Please note that, if paying by cash, the exact amount must be provided as change will not be made. Credit or debit card are accepted: Either online at www.GovPayNOW.com or by calling 888-604-6888. #6373 is necessary when referring to pay location code. There is a fee for this service.

After receiving restitution payments from offenders, the Probation Department, in a timely manner, mails those funds to victims. Restitution disbursals are made in the form of a check. Victims with questions regarding restitution payments or balances should contact the Probation Department at (315) 366-2351.
