Electronic Monitoring
A Probation Department may recommend to a criminal court that a defendant
be sentenced to a period of electronic monitoring in lieu of incarceration or
as an additional supervision tool. Electronic Monitoring is a means of social
control that enables the offender to support himself and/or dependents, attend
school, participate in treatment or counseling and remain in the community.
It provides the courts with an option other than incarceration.
Public and Victim Safety, the nature of the crime or violation of probation,
prior legal history of the defendant, and the extent that the restriction
may ameliorate the conduct which gave rise to the offense or may prevent
incarceration are all taken into consideration when identifying suitable
cases to be sentenced to the Electronic Monitoring Program.
